What Happens at a Hearing?
Before the hearing...
- If a complaint moves to a hearing, legal counsel will contact you to set up a date.
- You will receive an official Notice of Hearing at least 21 days beforehand.
- Your employer will also receive a copy of the official notice.
At the hearing...
- The board will review your submission and the EMA Licensing Branch’s submissions and decide whether the facts support the allegations.
- If the board finds that the facts support the allegations, the board will decide on an appropriate disciplinary action and/or educational measure.
- You and the EMA Licensing Branch can make a submission on the type of disciplinary action to be imposed.
- The board’s decision will be distributed to you, your employer, the complainant, and their legal counsel.
Important Things to Know about Hearings
- Hearings are public.
- The complainant or the EMA complained about (respondent) can make a request for a private hearing.
- The board has to be satisfied that a private hearing in whole or in part is appropriate for this to be allowed.
- If the respondent does not attend the hearing, the board may proceed without the respondent’s participation.
