What if we just want to settle without lawyers and insurance companies?
- Depending on the stage of the claim, you are still required to comply with the Act. Please see S. 13 of Health Care Costs Recovery Act.
What if I forget and do not advise the government? Is there a penalty?
- Please refer to s. 13 (5) of Health Care Costs Recovery Act.
- Please ensure you contact the appropriate authority at either the Ministry of Attorney General or Ministry of Health, Third Party Liability department. For a list of names and numbers please see contacts listing.
What if the accident involves an infant or person under a disability?
- The Health Care Costs Recovery Act still applies. Please seek legal advice and you can also reference the Civil Supreme Court Rules for British Columbia.
Is a Committee the same as a litigation guardian?
- Although they have similar responsibilities please seek legal advice for further clarification.
Can the forms be filled in on the computer?
- Yes, they can typed in and printed. Please see forms within this website for that purpose.
Can we fill in the forms in ink or do they have to be typed?
- Yes, although they must be in ink and easily readable and able to be faxed, e-mailed, or photocopied if required. As the forms are linked to this web site we would strongly encourage their use.
